PRE-ORDER TERMS AND CONDITIONS

These booking terms (“Booking Terms”) apply to you (hereinafter referred to as “You” or “Your” or “Customer”) and Plot No.:- 15-A, Iindustrial Zone, Opp.Bapa Sitaram Weight Bridge, Vehlal Road, Village-Zak Dist. Gandhinagar (Gujarat) For VX1 ("Scooter") with Us.

Kindly read and understand these Booking Terms carefully. If these Booking Terms are not acceptable to You or You are not eligible to accept these Booking Terms or book the Scooter under the applicable laws, please do not proceed with the booking. To the extent applicable, You hereby give your consent to receiving marketing and/or promotional communications from Us through all communication channels including but not limited to SMS, WhatsApp, e-mails and push notifications.

1. PRE-ORDER

By accepting these Booking Terms, You hereby confirm that You wish to pay an advance for COMPTECH scooter which will be set off from the final price of the vehicle at the time of purchase. You understand that We may not have begun manufacturing the Scooter at the time of Your pre-order or Scooter may still be in development stage. Placing a pre-order does not guarantee that Scooter will be available to You nor does it constitute an offer to sell. However, in case the scooter is not allotted to you, the pre-order amount would be refundable in full.

The amount that you are paying does not include any taxes including but not limited to Goods and Service Tax.

2. NATURE OF AGREEMENT; NON-BINDING PRE-ORDER PAYMENT

Subject to clause 6 below, the pre-order payment is the amount stated in the payment description provided to you in connection with this Booking Terms (“Pre-Order Payment”) and is refundable should you decide not to purchase a Scooter; subject to the conditions that You have not (i) already entered into a purchase agreement with OET; or (ii) paid for the Scooter in full; or (iii) have already purchased the Scooter. This Agreement does not constitute an agreement for the sale of a Scooter and does not lock in pricing, a production slot, or an estimated delivery date. This Agreement does not create an obligation on You to purchase a Scooter from Us and does not create an obligation on Us to manufacture and sell the Scooter. If and when We notify You of the availability of a Scooter and You wish to proceed with the purchase of a Scooter, such sale and purchase will be governed by a separate and legally binding purchase agreement between You and Us or between You and a dealer authorized by Us.

3. EFFECTIVE DATE; PRE-ORDER PROCESS

These Booking Terms shall become effective and shall apply to You when we receive both: (1) Your consent to agree to these Booking Terms and (2) Your Pre-Order Payment. Once these Booking Terms become effective and applicable, You will be placed on the pre-orders list and You will receive communication about the Scooter. It is clarified that in respect of Clause 3(2) your payment in the event of any post-paid payment mechanisms offered by any payment gateways/wallets will be deemed to be accepted only when the same has been cleared by the respective payment gateways/wallets. In the event the same is not cleared, your booking shall automatically stand cancelled.

Upon successful payment of Booking Amount, the system will generate a transaction order ID, acknowledging the receipt of payment towards the booking of the Scooter made online. Comptech Motocorp may require certain information or documents for undertaking its obligations and performance under these Booking Terms. You represent and warrant that the information provided is accurate and complete. All collection, storage, and disclosure of information or documents provided by You and/or shared by a third party will be in accordance with our Privacy Policy.

You hereby agree to receive email communication/newsletters (promotional and marketing emails) from Comptech Motocorp. You further expressly waive Do Not Call (DNC) / Do Not Disturb (DND) registrations on Your phone/mobile numbers for contacting You for such promotional/marketing purposes.

4. PURCHASE PRICE

The price of the Scooter and any option pricing may not be available at the time of Your pre-order and, if pricing is available, it is subject to change without any intimation to You until agreed upon in a duly executed purchase agreement.

5. DEFERRAL, MODIFICATION AND NON-TRANSFERABILITY

If You do not wish to enter into a purchase agreement at the time that you are contacted by Us, You will give up your pre-order sequence position completely and/or will be entitled to defer to a later position as determined subject to the conditions below. However, such deferral is permitted only 1 (one) time. If You do not communicate Your decision to us within ten (10) days of notification, You will automatically be granted such a deferral. This Agreement is not transferable or assignable to another party without the prior written approval by Us. You may also modify the variant or color of the Scooter based on availability anytime, however, such modification may change Your priority or pre-order sequence.

6. PRIORITY

We will establish your pre-order sequence position at our sole discretion. We may decline pre-orders to avoid over-subscription if We are unable to commence shipping of the Scooter to Your region or as We deem appropriate in our sole discretion. If Your pre-order is declined, You will be notified and Your Pre-Order Payment will be refunded within 15 working days of such refund being initiated.

8. LIMITATION OF LIABILITY

Notwithstanding anything under this Agreement, if We are held liable for any damages related to Your pre-order or this Agreement, Your sole and exclusive remedy will be limited to reimbursement of the Pre-Order Payment paid to Us and you agree that Our cumulative liability whether under tort or contract or otherwise will be limited to the reimbursement of the Pre-Order Payment.

Further, under no circumstances will We be held liable for any indirect or consequential loss or damage, including any and all (a) loss of opportunity (including loss of contract or right to offer or tender); (b) lost opportunity cost; (c) loss of business; (d) reduction or damage to goodwill; (e) damage to name or reputation; (f) loss or corruption of data, and regardless of whether any or all of these circumstances are considered to be indirect or consequential losses or damage, in contract, tort (including negligence), under any statute or law or otherwise arising out of our breach of this Agreement, even if We have been advised of the possibility of occurrences which would or might lead to such loss or damages.

9. GOVERNING LAW AND JURISDICTION

This Agreement is governed by the laws of India without regard to its conflict of law provisions. Disputes that arise from the Agreement, and which cannot be settled amicably through mutual negotiation, shall be subject to the exclusive jurisdiction of the courts at Gandhinagar – Gujarat.

10. MISCELLANEOUS

Comptech Motocorp reserves the right to change any of the terms and conditions of these Booking Terms at any time. We will provide notice of any material changes by posting an announcement on the official website of Comptech Motocorp. You may review these terms regularly to ensure that You are aware of any changes made by us. The continued use of our Website / Services by You, after changes are posted means that You agree to be legally bound by these Terms and Conditions as updated and/or amended. In the case of any violation of these Terms and Conditions or any additional terms posted on Our Website, we reserve the right to seek all remedies available by law and in equity for any such violations.

If any provision of these Booking Terms is held to be unenforceable, it shall be severed and the remaining provisions will remain enforceable. The severed provision will be replaced by an enforceable provision most nearly reflecting the intention of the parties.

11. DISCLAIMERS

You shall ensure compliance with all applicable laws including the applicable provisions of the Information Technology Act, 2000 and its allied rules as amended from time to time.

All personal data accumulated will be acquired, processed, and used according to the applicable regulations governing the protection of personal data for the sole purpose of managing and maintaining Comptech Motocorp's own legitimate business interests.

The use of this Website / Service is entirely at Your own risk, and in no event will Comptech Motocorp be liable for any damages, including without limitation direct or indirect, special, incidental, punitive, exemplary, or consequential damages, losses or expenses arising in connection with the Website / Service or any linked site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, etc. even if Comptech Motocorp or its authorized representative has been advised of the possibility of such damages. To the fullest extent permitted by law, Comptech Motocorp

  1. excludes all representations and warranties relating to this Website / Services and its content or which is or may be provided by any other third party, including in relation to any inaccuracies or omissions in the Website / Services; and
  2. excludes all liability for damages arising out of or in connection with the disclosure of the information and/or Your use of the Website. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profits was foreseeable, arose in the normal course of things or You have advised Us of the possibility of such potential loss), damage caused to You in any manner whatsoever including but not limited to Your computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

You shall indemnify and hold harmless Comptech Motocorp, its affiliates, subsidiaries, and its respective officers, directors, agents, and employees, from any losses, claims, chargebacks or demand, or actions including reasonable attorneys' fees, or penalty imposed due to or arising out of breach of these terms and conditions, Terms of Use, Privacy Policy, and other policies of Comptech Motocorp by You, Your use of the Website/Services or any act or omission of Yours in violation of any law, rules or regulations or the rights (including infringement of intellectual property rights) by You.

Part 2: COMPTECH SCOOTER BOOKING TERMS AND CONDITIONS

These booking terms (“Booking Terms”) apply to you (hereinafter referred to as “You” or “Your” or “Customer”) and Plot No.:- 15-A, Industrial Zone, Opp. Bapa Sitaram Weight Bridge, Vehlal Road, Village-Zak Dist. Gandhinagar (Gujarat) For VX1 ("Scooter") with Us. Kindly read and understand these Booking Terms carefully. By continuing your payment journey and making the final advance payment, you agree to the Booking Terms. If these Booking Terms are not acceptable to You or You are not eligible to accept these Booking Terms or to book the Scooter under applicable laws, please do not proceed with the booking. To the extent applicable, You hereby give your consent to receiving marketing and/or promotional communications from Us through all communication channels including but not limited to SMS, WhatsApp, e-mails, and push notifications. Please note that these Booking Terms are applicable only to the sale of Comptech Scooters in India.

1. BOOKING

By accepting these Booking Terms, You hereby confirm that You wish to pay the final advance for the Comptech scooter and thereby finalize your intent to purchase the Comptech Scooter. You understand that the manufacture of the Comptech Scooter is contingent upon several factors including but not limited to the availability of parts and therefore the delivery time is indicative and not binding on Us. Booking a Comptech Scooter does not guarantee that a Comptech Scooter will be made available to You nor does it constitute an offer to sell. However, if the Comptech Scooter is not allotted to you, the booking amount would be refundable in full.

2. NATURE OF AGREEMENT, CANCELLATION, AND REFUND POLICY

Subject to Clause 4 below, the Booking amount is the amount stated in the payment description provided to you in connection with these Booking Terms (“Booking Amount”) and is refundable should you decide not to purchase the Comptech Scooter, subject to the condition that the final invoice for the payments against the Comptech Scooter is not raised by Us. The refund amount is subject to applicable deductions on account of costs which will be borne by Us to initiate and process such Cancellation Request. Once the invoice is generated, You will not be eligible for cancellation/refund of your Booking. These Terms and Conditions constituting the Final Purchase Agreement shall be communicated to you on your registered email ID and mobile number when you are intimated that Your Comptech Scooter is ready to be shipped, which as stated above shall come into effect at the time the Comptech Scooter is shipped from the Comptech Future Factory.

Comptech Motocorp may require certain information or documents for undertaking its obligations and performance under these Booking Terms. You represent and warrant that the information provided is accurate and complete. All collection, storage, and disclosure of information or documents provided by You and/or shared by third parties will be in accordance with our Privacy Policy. You hereby agree to receive email communication/newsletters (promotional and marketing emails) from Comptech Motocorp. You further expressly waive Do Not Call (DNC) / Do Not Disturb (DND) registrations on Your phone/mobile numbers for contacting You for such promotional/marketing purposes.

4. DEFERRAL, MODIFICATION, AND NON-TRANSFERABILITY

If You do not wish to enter into the Final Purchase Agreement at the time that you are contacted by Us, You will give up your Booking position completely and the terms of Cancellation and Refund described above shall follow. You may be given an option to defer to a later Booking position as determined in Our sole discretion. However, such deferral, if permitted, can be availed only 1 (one) time. This Agreement is not transferable or assignable to another party without the prior written approval by Us.

5. TEST RIDES

We will be opening the booking for Test Ride slots in select cities and You will receive the intimation of the same on your registered email ID and mobile number. Should you choose to book a Test Ride, you are requested to carefully read and then agree to the Test Ride Terms and Conditions which will be made available.

6. OPTIONAL ACCESSORIES

You agree and acknowledge that the Performance Upgrade for Comptech VX1 and the Home Charger manufactured and sold by Comptech Motocorp Pvt Ltd are optional accessories only and come for the indicated cost.

7. INTELLECTUAL PROPERTY

We alone (along with Our licensors, where applicable) own all rights, title, and interest, including all related intellectual property rights, in relation to The Comptech Scooter, any related services, and any suggestions, ideas, enhancement requests, feedback, recommendations, or any other offering; Text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code; or other information provided by You or any other party relating to the Comptech Scooter or any related services. Third-party trademarks, if any, may appear on the Platform and all rights therein are reserved to the registered owners of those trademarks. For the use of any third party's intellectual property, You need to get permission directly from the owner of the intellectual property for any use.

These Booking Terms do not convey to You any rights of ownership in or related to the Application or the Service, or any intellectual property rights owned by Us. You shall be solely responsible for any violations of any laws and for any infringements of any intellectual property rights caused by the use of the Comptech Scooter or any related services.

8. WARRANTY

The installation service has a warranty of 6 months, which is applicable from the date of installation of the service. During this period, repairs or replacement will not be charged.

WARRANTY POLICY / TERMS AND CONDITIONS

This Warranty should be considered as a permanent part of the vehicle and should remain with the vehicle when sold or transferred to a new owner. All information, illustrations, photographs, and specifications contained in the Owner's Manual are based on the latest product information available at the time of its publication. The Company may, however, incorporate modifications or improvements on its vehicles at any time, without notice and therefore, in such events, it is possible that some parts of the Owner's Manual may not apply to your vehicle. Prior written permission of the Company is required for quoting, copying, or reproducing any part or in full of the Owner's Manual. Accessories shown in the picture may not be part of the standard equipment.

The Company shall not be liable for any delay in servicing due to reasons beyond the control of the Company. Except for the limited warranties described herein, the Company does not provide any other warranty, whether express, implied, statutory, or otherwise. The limited warranties contained in this booklet are issued in Gandhinagar and any claim relating to or arising out of the warranty terms herein shall be subject to the courts at Gandhinagar which shall have the exclusive jurisdiction to entertain and adjudicate the said claims.

Owner’s Responsibility

Please take proper care, proper use, and maintenance of the vehicle in accordance with the instructions provided in the Owner’s Manual. If the vehicle is subjected to severe usage conditions, such as operating in extremely dusty, rough, or heavy city traffic during hot weather or during the monsoons, usage of vehicles with underinflated wheels, maintenance of the vehicle may have to be done more often. Maintenance service records will be maintained by the Company and can be made available to the Customer on request.

In order to maintain the validity of this Warranty on the vehicle, the vehicle must be serviced by the Company Authorized workshop in accordance with the Owner’s Manual.

SERVICE TERMS AND CONDITIONS

Before any battery warranty claim, the batteries are to be charged and discharged for at least 6 consecutive cycles. Batteries are to be charged and discharged using the COMPTECH individual battery charger and discharger. The batteries should not be kept in resting condition for a long period. The batteries should not be charged for more than 6 hours. When the vehicle is meant to be kept idle, the scooter should have more than 50% of charge and the MCB should then be turned off. In order to extend the lifespan of the vehicle, please use COMPTECH genuine parts and accessories only.

NOTE: The user should follow all maintenance guidelines provided in the Manual to avail warranty claims.

OTHER TERMS & CONDITIONS

AFTER SALES SERVICE AND GUARANTEE

In order to protect your legal rights, please retain a copy of this Manual. Kindly carry out spot checks and adjustments if required for your vehicle during purchase. You hold all rights to request the Dealer or sales personnel to brief the vehicle operation instructions, maintenance requirements and proof of purchase invoice, service guarantees and battery warranty cards, duly signed and sealed from where the vehicle is purchased. It is mandatory to provide the proof of purchase and the warranty card to the dealer to get your vehicle serviced or for battery servicing.

WARNING

For any dispute arising out of words/commitments, COMPTECH leaves the responsibility to the Dealers. COMPTECH will supply spares only till the warranty period as per this book. Warranty, other than that mentioned in this book, communicated orally, written or given in any other form by any means, is invalid.

Do's Don'ts
Read the owner's manual carefully. Never insert ignition key & twist the throttle of vehicle when resting on side stand.
Maintain tyre pressure, periodic check at least once a week, recommended tyre pressure: Front is 30psi & Rear is 36psi. Never drive on low inflated tyre pressure; it may result in loss of control as well as power loss in vehicle.
Keep your vehicle battery charged with the charger supplied. Never cover the battery charger while charging & after charging allow it to cool down then cover.
Always make sure that the charger is properly connected before switching on the charger. Never insert the ignition key in scooter while charging for any check like charging status. This will damage the charger.
Always check before riding, that the brake lever switches are functioning properly & the motor is cut off, this will help in saving battery power. In case of non-function/faulty switch refer your nearest dealer. Never overload the vehicle as this may reduce your running distance.
Always get the vehicle serviced on time & it will be helpful to you in availing warranty (warranty shall be void in case of service not done on time). Never give full throttle in starting; instead, raise the throttle gradually for achieving right pickup & this will help in saving battery power.
Always apply both the brakes at the same time for better braking. Never drive without a helmet for your own safety & follow safety rules.
Always lock properly when parking the vehicle. Never leave keys in vehicle when not in use.
